| SSP is incorporated
in Part II of the Negative List of current
Export Import Policy. Export of SSP
is permissible subject to issue of Export
Licence by the office of Directorate
General of Foreign Trade based on the
recommendation of Department of Fertilizers.
1. WHO ARE
ELIGIBLE FOR EXPORT OF SSP?
Both Manufacturer Exporters and
Merchant Exporters (Export Houses/Trading
Houses/Star Trading Houses) are
eligible to export SSP to Bangladesh
or any other country.
2. WHAT
IS THE PROCEDURE?
(i) The intending exporter
is required to submit an application
for export of SSP fertilizer in
the prescribed form (Appendix XXXVIII)
of the Handbook of Procedure issued
by Directorate General of Foreign
Trade. Ministry of Commerce, Udyog
Bhavan, New Delhi. He is also required
to furnish his Registration-cum-Membership
Certificate (RCMC) number granted
by the concerned Export Promotion
Council. The Export Licencing Committee
constituted by the DGFT considers
such applications on merits for
issue of export Licences for Exports.
(ii) The Directorate General
of Foreign Trade places such applications
for consideration before the Export
Licencing Committee (ELC) only after
the administrative department i.e.
Department of Fertilizers has issued
No Objection Certificate (NOC) for
export of SSP.
(iii) To avoid delay in
the issue of NOC, the applicant
can apply simultaneously to the
Directorate General of Foreign Trade,
Ministry of Commerce, Udyog Bhawan,
New Delhi for issue of Export Licence
and to the Department of Fertilizers
for issue of NOC.
3. DOCUMENTS
REQUIRED TO BE ATTACHED WITH THE APPLICATION
FOR OBTAINING NOC FROM THE DEPARTMENT
OF FERTILIZERS
A. BY MANUFACTURER EXPORTER
(a) A true copy of the export
order from the foreign buyer indicating
quantity, quality specifications,
rate/MTs, delivery schedule, etc.
or irrevocable L.C.
(b) An undertaking duly
signed by the Chief Executive of
the Manufacturer Exporter to the
effect that no concession/subsidy
admissible on the sale of SSP within
the country would be claimed on
such quantity of SSP, which is exported.
The similar undertaking will also
need to be submitted with the application
filed in the office of DGFT.
(c) Data regarding installed
capacity of the plant, opening stock,
production and sale of SSP for the
last three years alongwith upto-date
status.
(d) A statement indicating:
(i) the quantities of SSP
already committed for export through
the Export House and the quantities
actually supplied for export; and
(ii) the quantity permitted
for export against their own NOC/Export
Licence alongwith quantities actually
exported.
(e) Any other related information
required at the time of scrutiny
of the application.
B. BY MERCHANT EXPORTER (EXPORT
HOUSE/TRADING HOUSES/STAR TRADING
HOUSE)
(a) A true copy of the export
order from the foreign buyer indicating
quantity, quality specifications,
rate/MTs, delivery schedule, etc.
or irrevocable L.C.
(b) An undertaking duly
signed by the Chief Executive of
the Merchant Exporter to the effect
that no concession subsidy admissible
on the sale of SSP within the country
would be claimed on such quantity
of SSP, which is exported.
The similar undertaking will also
need to be submitted with the application
filed in the office of DGFT.
(c) An agreement with the
manufacturer supplier committing
supply of SSP for export.
(d) An undertaking duly
signed by the Chief Executive of
the SSP supplier to the effect that
no concession/subsidy admissible
on the sale of SSP within the country
would be claimed on such quantity
of SS, which is exported.
The similar undertaking will also
need to be submitted with the application
filed in the office of DGFT.
(e) Progress of implementation
of earlier NOC/Export Licence, if
any.
(f) Any other related information
required at the time of scrutiny
of the application.
4. QUANTITIES
ADMISSIBLE FOR EXPORT OF SSP AT A
TIME?
At a time, NOC is given for export
of SSP for a maximum quantity of
20,000 MTs.
5. OBLIGATIONS
OF THE EXPORTER?
(i) The company will be
required to execute the export order
within a period of six months from
date of issue of the Export Licence.
Further extension will be granted
on full justification only on the
recommendation of Department of
Fertilizers.
(ii) The material should
conform to the quality specifications
given by the importer.
(iii) In case the exporter
is the manufacturer of SSP, he will
ensure that at least 50% of the
annual production of SSP is sold
for domestic consumption.
(iv) The export price should
not be less than the normal realisation
on its sale for domestic consumption.
6. ELIGIBILITY
OF THE EXPORTER FOR SUBSEQUENT NOC/EXPORT
LICENCE FOR EXPORT OF SSP
(i) The request for subsequent
NOC for export of SSP would be considered
only after the Manufacturer Exporter
or Merchant Exporter has exported
75% of the earlier authorized quantity.
(ii) That the firm has been
furnishing the required monthly
returns regularly.
7. RETURNS
TO BE SUBMITTED AFTER EXPORT LICENCE
IS OBTAINED
(i) The Merchant Exporter
will submit monthly returns in respect
of export effected by 10th of the
following month regularly.
(ii) The manufacturer supplies
will also submit monthly returns
in respect of production and the
quantity supplied to Merchant Exporter
for export by 10th of the following
month regularly.
(iii) The manufacturer exporter
will submit monthly return for production,
export etc. in respect of NOC/Export
Licence issued in its own name by10th
of the following month regularly.
(iv) The returns should
be addressed to the Under Secretary
in the Department of Fertilizers,
Shastri Bhawan, New Delhi and the
Director (Fertilizers) Department
of Agriculture & Cooperation,
Krishi Bhawan, New Delhi.
